EPA Extends Stay of New Source Review Rule For Fugitive Emissions Through March 2010

The Environmental Protection Agency issued an interim final rule Dec. 11 extending the stay of a rule that addresses whether certain industries must count "fugitive emissions" in determining whether new source review applies (74 Fed. Reg. 65,692).rnEPA's interim final rule stays the fugitive emissions rule until March 31 as it considers a petition for reconsideration from the Natural Resources Defense Council. EPA issued a three-month administrative stay of the rule Sept. 30; that stay will expire Dec. 30 (74 Fed. Reg. 50,115; 40 ER 2279, 10/2/09).
