Court Narrows Weapons Plant Lawsuit To Neighbors Exposed to Radiation in 1961

A federal court in Ohio has ruled that a class action lawsuit is still the appropriate form of adjudication for neighbors claiming radiation exposure from a nuclear weapons facility, but the court narrowed the class to include only those exposed to radiation during 1961 (Stepp v. Monsanto Research Corp., S.D. Ohio, No. 3:91cv468, 2/24/12).In a Feb. 24 decision, the U.S. District Court for the Southern District of Ohio also rejected the defendants' arguments that the class should be decertified because the court's earlier rulings on the defendants' requests to dismiss and for summary judgment narrowed the scope of the litigation.
