The U.S. Supreme Court on June 3 rejected a request for review from two mining companies challenging the U.S. Forest Service's use of the National Environmental Policy Act to limit vehicular traffic in the Payette National Forest in Idaho (American Independence Mines and Minerals Co. v. USDA, U.S., No. 12-935, 6/3/13). In rejecting a petition for a writ of certiorari filed by American Independence Mines and Minerals Co. and Ivy Minerals Inc., the Supreme Court allowed to stand an August 2012 decision by the U.S. Court of Appeals for the Ninth Circuit.
