States Urge Federal Appeals Court to Uphold EPA Mercury Standards for Power Plants

Sixteen states and five local governments supported the federal mercury air toxics standard in a court filing, saying that although some states restrict mercury emissions from power plants, federal rules are necessary because those states still suffer from emissions from neighboring jurisdictions (White Stallion Energy Center LLC v. EPA, D.C. Cir., No. 12-1100, brief filed 2/21/13). The intervenors backing the Environmental Protection Agency, including California, Illinois, and New York, urged the U.S. Court of Appeals for the District of Columbia Circuit in a Feb. 21 brief to uphold EPA's mercury and air toxics standards (MATS) for power plants.
