EPA Revision to Appeals Board Rules Reflects Current Practices on Briefing

The Environmental Protection Agency is revising its regulations to do away with a second round of ' briefing in Environmental Appeals Board permit appeals cases, according to a final rule to be published Jan. 25. In practice, the appeals board generally seeks just one round of briefs as soon as an appeal is filed, EPA said, and the regulations at 40 C.F.R. Parts 124 and 270 are being amended to reflect that practice.
