EPA Power Plant Rule Violates Plain Text Of Clean Air Act, Murray Energy Says

An Environmental Protection Agency proposal to regulate carbon dioxide from existing power plants is illegal on its face and should be blocked, Murray Energy Corp. told a federal appellate court (In re Murray Energy Corp., D.C. The EPA's proposed carbon dioxide emissions guidelines for existing power plants, known as the Clean Power Plan, violate the "unambiguous" text of the Clean Air Act, which prevents the EPA from issuing both national and state-by-state emissions standards for the same industrial source category, Murray Energy said in a court brief filed Dec. 15 in the U.S. Court of Appeals for the District of Columbia Circuit.
