San Francisco Baykeeper Threatens to Sue San Jose for Alleged Stormwater Violations

An environmental group has threatened to sue the city of San Jose for allegedly failing to prevent trash, fecal bacteria and other pollutants from washing into creeks, rivers and ultimately San Francisco Bay. The warning from the San Francisco Baykeeper came in a Nov. 24 intent-to-sue notice, accusing the city of violating the Clean Water Act by not meeting the terms of the National Pollutant Discharge Elimination System permit it shares with other Santa Clara County cities. In a Nov. 24 news release, the Baykeeper said the citizen action "aims to compel" the city to implement effective controls to clean up stormwater runoff, including trash capture devices and green infrastructure measures that can capture stormwater for reuse in landscaping.
