Federal Appeals Court Hears Farm Group, EPA Arguments on Chesapeake Bay TMDL

If farm groups prevail in their lawsuit challenging the water quality cleanup plan for the Chesapeake Bay established by the Environmental Protection Agency in 2010, "the Bay won't recover," Jon A. Mueller of the Chesapeake Bay Foundation told a federal appeals court (Am. Farm Bureau Fed'n v. EPA, 3rd Cir., No. 13-4079, oral arguments 11/18/14). During the Nov. 18 oral arguments, Mueller told a three-judge panel of the U.S. Court of Appeals for the Third Circuit in Philadelphia that only the EPA can compel upstream states to do their part to improve water quality in the bay.
