Appeals Court Will Not Consider Challenge To EPA Controls on Ozone-Depleting HCFCs

A federal appeals court will not review the Environmental Protection Agency's denial of a petition that sought reconsideration of an agency rule that revised the allowance system for production of two ozone-depleting refrigerants (New Era Grp. v. EPA, D.C. Cir., No. 14-1054, order issued 10/3/14). The U.S. Court of Appeals for the District of Columbia Circuit, in an Oct. 3 order, granted a motion for summary denial of the lawsuit after determining that the New Era Group LLC, a group that represents refrigerant resellers, reclaimers and alternative refrigerant manufacturers, didn't having standing to challenge the EPA's decision on the grounds identified in the group's petition for review.
