Sierra Club Joins States in Challenging EPA Approval of Virginia Ozone Plan

The Sierra Club petitioned a federal appeals court to review the Environmental Protection Agency's approval of a Virginia ozone plan that fails to address pollution that crosses state lines, joining two states in challenging the agency's decision (Connecticut v. EPA, 4th Cir., No. 14-1490, consolidation order issued 5/29/14). The Sierra Club, in a lawsuit filed May 28, requested that the U.S. Court of Appeals for the Fourth Circuit review a March EPA final rule approving Virginia's state implementation plan to meet the 2008 national ambient air quality standards for ozone (79 Fed. Reg. 17,043). The appeals court May 29 consolidated the Sierra Club lawsuit with a lawsuit filed by Connecticut and Maryland challenging the EPA's approval of the Virginia state implementation plan (45 ER 1600, 5/30/14).
