D.C. Circuit Upholds Renewables Standard For 2013 Despite It Being Eight Months Late

Federal appellate judges May 6 unanimously rejected challenges to the Environmental Protection Agency's renewable fuel standard for 2013 despite the rule being issued more than eight months late (Monroe Energy LLC v. EPA, D.C. Cir., No. 13-1265, 5/6/14). The U.S. Court of Appeals for the District of Columbia Circuit ruled the EPA acted within its statutory authority when it reduced the cellulosic ethanol blending requirement for 2013 but didn't reduce the overall advanced biofuel mandate. Cellulosic ethanol is a subset of advanced biofuels.
