EPA Seeks to Block McCarthy Deposition In Lawsuit Over Air Rules' Jobs Impact

The Environmental Protection Agency is asking a federal appellate court for a writ of mandamus to prevent Administrator Gina McCarthy from being deposed in a coal company's lawsuit seeking to force the agency to review the impact its Clean Air Act regulations have on jobs (In re Gina McCarthy, 4th Cir., No. 15-2390, 11/10/15). As a senior administration official, McCarthy should not be called to testify in the lawsuit brought by Murray Energy Corp., the EPA said in its petition for a writ of mandamus filed Nov. 10 in the U.S. Court of Appeals for the Fourth Circuit. The agency is asking the court to respond by Nov. 20.
