EPA's Clean Power Plan, Coal Ash Rule Targeted in Bush Plan for Regulations

Republican presidential candidate Jeb Bush vowed to repeal or overhaul Environmental Protection Agency rules setting carbon dioxide emissions limits on power plants, defining Clean Water Act jurisdiction and regulating coal ash as part of a regulatory agenda released Sept. 22. If elected president, Bush vowed to freeze publication of all proposed and final rules until they could be reviewed by an agency head appointed by him. As part of a push for "smart regulation," Bush would require federal agencies to favor state-based solutions over federal programs, adopt best practices pioneered by states, ensure that benefits of regulation outweigh costs "using an honest and transparent methodology" and select the least-cost options for regulated entities. Bush would also establish an independent regulatory commission to periodically review rules to ensure they are still cost effective and necessary.
