Mercury Standards Likely to Remain in Place During Remand to EPA, Attorneys Predict

Two attorneys predicted that a federal appeals court will leave the Environmental Protection Agency's mercury and air toxics standards for power plants in place while the agency addresses a recent decision by the U.S. Supreme Court. Andrew Grossman, an attorney with BakerHostetler and an adjunct scholar at the Cato Institute, and Richard Revesz, Lawrence King Professor of Law and dean emeritus of the New York University School of Law, both said that the U.S. Court of Appeals for the District of Columbia Circuit will likely remand the mercury standards back to the EPA for further consideration without vacating the standards. Grossman and Revesz spoke during a July 16 teleconference hosted by the American Bar Association.
