Alternative Compliance Rule for Mercury, Air Toxics Challenged by Utility Industry

A power plant industry group is asking a federal appeals court to consider whether the Environmental Protection Agency complied with Clean Air Act requirements when the agency established an alternative method for compliance with mercury and air toxics standards during startup and shutdown (Util. Air Regulatory Grp. v. EPA, D.C. Cir., No. 15-1013, statement of issues filed 2/20/15). The Utility Air Regulatory Group, in a statement of issues filed Feb. 20, questioned whether portions of the alternative work practice standards, associated record-keeping and reporting requirements and new monitoring requirements for particulate matter "are arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with the law."
