EPA Air 'Consistency' Exception Challenged By Oil and Gas Industry Trade Group

The Environmental Protection Agency's decision to add an exception to its policy requiring regional offices to "uniformly apply" Clean Air Act programs is being challenged in federal appeals court by the American Petroleum Institute (Am. Petroleum Inst. v. EPA, D.C. Cir., No. 16-1345, 10/3/16). The agency in August established what it described as a "narrow procedural exception" to its regional consistency rules that will authorize regional offices to implement locally or regionally applicable court decisions without affecting national policy. The oil and gas trade association filed an Oct. 3 lawsuit over the rule with the U.S. Court of Appeals for the District of Columbia Circuit.
