Injunction Vacated for BLM Fracking Rule While Agency Continues Fight for Rule Itself

A preliminary injunction against federal regulations on hydraulic fracturing was vacated by an appellate court July 13, adding one extra legal wrinkle to a case that remains on appeal (Wyoming v. Interior, 10th Cir., No. 15-8126, 7/13/16). The preliminary injunction, issued Sept. 30, 2015, by the U.S. District Court for the District of Wyoming, had stopped the Bureau of Land Management from enforcing its rule governing fracking on federal and Indian lands (RIN:1004-AE26). The district court then overturned the rule as unlawful June 22.
