Roadbuilders Ask D.C. Circuit to Reconsider Language Used in California Engine Ruling

A federal appeals court should clarify language used in an opinion on California nonroad diesel engine standards to avoid ruling on whether those California standards can be legally adopted by another state, a transportation industry group said (Dalton Trucking Inc. v. EPA, D.C. Cir., No. 13-1283, petition for reconsideration filed 2/1/16). The American Road & Transportation Builders Association filed a Feb. 1 petition that requested the U.S. Court of Appeals for the District of Columbia Circuit reconsider its Dec. 18 ruling, which held that the Ninth Circuit was the correct venue to hear challenges to the Environmental Protection Agency's approval of California's authority to enforce state standards on emissions from in-use, nonroad diesel engines (Dalton Trucking Inc. v.
