ANALYSIS: Three Key Tips for Optimizing Your eDiscovery Process

Electronic discovery evolves constantly. But three main keys to success consistently prevail: planning, flexibility, and range. Know the available technology and what you need toaccomplish, don’t be afraid to double back and regroup, and make sure to use all the discovery tools available to you. You’ll be well on your way.These themes emerged as frequent topics at the 2021 Georgetown Advanced eDiscovery Institute I attended in Washington, DC last month. Specifically, speakers and contributorsemphasized the utility of technology-assisted document review, but they also stressed that attorneys must have an understanding of what technology-assisted review can do and whichTAR functions they want to use. That understanding creates a transparent, defensible path forward that will elicit, at most, minimal objections from opposing counsel or the court.
