ARCO, DuPont Brush Off Class in Public Housing Superfund Suit

DuPont de Nemours & Co. won’t have to defend Superfund claims filed byformer residents of a contaminated public housing complex as a class action, the Northern District ofIndiana ruled.The residents can’t proceed as a class because evaluating the Superfund costs allegedly incurred willrequire highly individualized inquiries into each class member’s conduct, the U.S. District Court for theNorthern District of Indiana said Oct. 22.
