Environmental Protection Agency must reconsider maximum achievable control technology standards under Clean Air Act for emissions of three hazardous air pollutants relying upon surrogate standards, because: (1) even though more than 60 days had passed since promulgation of notice of original standards used as surrogates, environmental group timely challenged use of surrogate standards as appropriate for three HAPs; (2) EPA must demonstrate reasonableness of use of particular surrogate in specific context; and (3) EPA failed to respond adequately to comments disputing EPA's explanations of reasonableness of use of standards as surrogates for three HAPs.
