A recent federal appellate court decision appears to limit a key industry defense in Superfund costs recovery suits while expanding regulators' ability to pursue potentially responsible parties (PRPs) for reimbursement of cleanup costs, according to attorneys. The decision for the first time interprets the manner in which Superfund site cleanup costs can be shared, and opens some historic manufacturers of chemicals to significant new cleanup liability.
