INDUSTRY URGES DOD TO IGNORE ENERGY LAW LIMITS ON FUELS' GHG LEVELS

Industry advocates for liquefied coal and unconventional oil production have developed legal arguments for the Defense Department to ignore provisions in the recently enacted energy law that bar federal agencies from purchasing unconventional fuels that emit more greenhouse gases (GHGs) than conventional petroleum. The legal analysis argues the military services, in particular the Air Force, are exempt from the requirement because they are not considered federal agencies under the definitions of the energy law and that the GHG limits are preempted by other fuel-purchasing directives for DOD laid out in other federal energy statutes.
