INDUSTRY SEEKS NOVEL GHG DEAL WITH EPA AFTER PERMIT REMANDED

Developers of the proposed Desert Rock coal-fired power plant are said to be seeking a deal with EPA and environmentalists laying out first-time greenhouse gas (GHG) requirements in a clean air permit, environmentalists say, after the agency's review board remanded the plant's permit so EPA can reconsider whether it can mandate use of a clean-burning generation technology as an emissions control. Some industry officials have said in the past that they expect they will have to deal with EPA on the issue under existing Clean Air Act authorities as they wait for Congress to pass legislation regulating GHGs.
