ACTIVISTS SCRAMBLE TO BLOCK COAL-FIRED UTILITY WITHOUT CO2 LIMITS

Environmentalists are scrambling to block a pending coal-fired power plant from construction without carbon dioxide (CO2) controls, eyeing EPA or Supreme Court intervention to halt the plant - which could be one of a handful of coal-fired utilities built without such controls before the agency begins regulating CO2 next year. Georgia's Supreme Court Sept. 30 rejected activists' appeal of a state appeals court ruling upholding an air permit for the Longleaf power plant without CO2 limits. The appeals court ruling overturned a first-time Georgia Superior Court ruling that said CO2 is already subject to regulation under the Clean Air Act and therefore the proposed 1,200-megawatt, pulverized coal power plant's permit should include specific CO2 limits.
