EPA is asking a federal appeals court to remand its new source performance standard (NSPS) for power plants so that it can reconsider the standards' limits for the criteria pollutants sulfur dioxide (SO2), nitrogen oxide (NOx) and paniculate matter (PM) in harmony with a pending strict air toxics rule for the power sector.rnThe agency asks the U.S. Court of Appeals for the District of Columbia Circuit for the remand in an Aug. 19 motion, just weeks before oral arguments were slated to take place in State of New York, et ai, v.
