EPA is legally defending its move to continue a controversial Bush EPA practice of exempting smaller facilities from Title V permitting requirements in a recently finalized air toxics rule, despite environmentalists' arguments that the permits are necessary to enforce emissions limits and are required by the Clean Air Act.rnAlthough EPA has provided the Title V exemption in almost every area source rule yet promulgated since a key 2006 air toxics court ruling, environmentalists had hoped the Obama administration would change agency policy and impose the requirements in its recent rule for aluminum, copper and other nonferrous foundries, as well as in several rules scheduled to be finalized by an Aug. 17 court deadline.
