A federal court in California has ordered the agency to publish a list of industries that would likely be subject to Superfund financial assurance rules, putting the agency on a path to develop rules that activists argue Congress required the agency to issue more than 20 years ago. The court, which dismissed EPA and industry arguments that environmentalists lacked standing to bring the case and were also time-barred by a statute of limitations, stopped short of ordering the agency to issue the rules however, saying the list "will shed light on the merits" of the environmentalists' argument that the rules are needed and required by the Superfund law.
