EPA is delaying the reporting of key data elements under its greenhouse gas (GHG) emissions reporting rule, in response to Federal Trade Commission (FTC) and industry concerns that the agency's original plan would have made public certain confidential business information (CBI) whose release could have harmed competitiveness and opened the door for unlawful collusion. The agency Dec. 20 announced both a proposed rule and interim final rule that will delay data inputs to emissions equations - which include product compositions, raw materials used, and other process-specific information - while EPA continues to weigh which information should be protected as CBI.
