Key Appeals Court Grants EPA Delay For Suits Over Climate Risk Finding

The U.S. Court of Appeals for the D.C. Circuit has granted EPA's request to delay consolidating multiple cases challenging EPA's climate endangerment finding, giving EPA until Aug. 16 to first respond to the slew of administrative petitions demanding a withdrawal of last year's climate risk determination before proceeding with the legal challenge.rnIn a June 16 decision, the court ordered that the case "be held in abeyance until fourteen days after EPA's decision on the petitions for reconsideration or August 16, 2010, whichever comes first." At the same time, the court ruled that motions by groups challenging the endangerment finding "to adduce additional evidence be denied in light of the pending petitions for reconsideration."
