Activists Plan 'Open Dumping' Suit To Leverage Hazardous Coal Ash Rule

Environmentalists are planning to sue utilities later this year over roughly a dozen aqueous coal ash disposal sites that they say violate longstanding "open dumping" rules under the Resource Conservation & Recovery Act (RCRA), litigation they hope will help persuade EPA and the Obama administration to regulate coal ash as a hazardous waste. The Environmental Integrity Project released a June 23 report detailing 33 coal ash disposal sites that violate the law's open dumping prohibitions because they have contaminated groundwater with excessive levels of various toxic chemicals.
