Industry groups are asking EPA to delay a recently finalized rule defining when non-hazardous materials are considered "waste" subject to strict incineration air rules when combusted or "fuels" subject to less-stringent boiler emissions rules, a move that comes in the wake of EPA's decision to delay the corresponding air regulations. A coalition of 10 groups, including the American Forest & Paper Association (AF&PA), American Chemistry Council, Rubber Manufacturers Association and others, on May 18 asked EPA for an immediate administrative stay of the rule, which determines whether combustion units must meet air toxics rules for boilers under the Clean Air Act or the more-stringent air toxics rules for incinerators.
