EPA Urges Appeals Court To Reject Petroleum Refiners' DSW Concerns

EPA is urging the U.S. Court of Appeals for the District of Columbia Circuit to reject industry complaints that its definition of solid waste (DSW) rule improperly subjects spent petroleum refinery catalysts to strict waste management requirements, arguing the industry claims are moot until the agency makes a final decision on whether to amend the rule. Last year, EPA reached a settlement agreement with environmental groups who had also sued over the DSW rule, arguing that it was too lax. Under the terms of the settlement, EPA has agreed to initiate a new rulemaking process for the DSW rule.
