DOJ Urges High Court Not To Hear GE Challenge To EPA Cleanup Orders

The Department of Justice (DOJ) is urging the U.S. Supreme Court not to hear the General Electric (GE) Company's long-running constitutional challenge to EPA's ability to issue unilateral cleanup orders under Superfund law, arguing that a lower court's prior decision on the issue is consistent with past rulings of the high court and other federal courts. GE petitioned the high court Dec. 29 to hear the case General Electric Co. v. Lisa Jackson, in which the company has so-far unsuccessfully argued that EPA's ability to issue unilateral administrative orders (UAOs) under Superfund is a violation of its due process rights.
