State air officials say EPA's draft guidance on how to exempt emissions produced by "exceptional events" -including dust storms and wildfires - from counting toward states' compliance with federal air standards fails to address their long-running concerns that the process is burdensome and may exacerbate their workload under the policy. Some industry groups, including organizations representing the power sector and major companies such as BP, are also weighing in with concerns about what they say is a complicated process for claiming an exceptional event. The utility industry also argues that EPA decisions on exceptional event claims should be judicially reviewable.
