EPA GHG Reporting Proposal Could Ease Industry Fears Of Releasing CBI

EPA is proposing alternative methods for industries to comply with its greenhouse gas (GHG) reporting rule as a way to address companies' concerns that the original requirement to submit inputs to emissions equations - which EPA deferred for several years - would have revealed their confidential business information (CBI), putting them at a potential competitive disadvantage. The proposed rule - signed Aug. 29 by EPA Administrator Gina McCarthy and slated for publication soon in the Federal Register-says that instead of the original equations that were required for reporting GHG data, the "alternative verification methods" that the agency is proposing "would maintain EPA's ability to verify data and ensure compliance without requiring reporting of data elements for which disclosure concerns have been identified; under the proposed amendment, such data would be kept as records rather than reported to the EPA."
