EPA Faces Suit Over 'Unreasonable' Delay Issuing GHG Rules For Utilities

Environmentalists and states are threatening to sue EPA alleging "unreasonable" delays in finalizing a greenhouse gas (GHG) new source performance standard (NSPS) for newly constructed utilities and developing a proposed NSPS for existing facilities, while EPA says it continues to review millions of comments on the new power plant rulemaking. Sierra Club, Environmental Defense Club and the Natural Resources Defense Council (NRDC) filed an April 15 notice of intent (NOT) to sue with EPA - two days after the agency missed a one-year Clean Air Act deadline to finalize its April 13, 2012, proposed NSPS for new power plants. EPA's publication of the proposal in the Federal Register triggered the one-year clock for the agency to formally issue the final version of the climate rule.
