Environmentalists are seeking to force EPA to consider sea-level rise and other effects of climate change in a proposed enforcement settlement seeking to prevent overflows in Miami-Dade County's sewage collection and transmission system, in a case which could force the agency to adopt a policy stance beyond its current posture. But the group, Biscayne Bay Waterkeeper, Inc., is facing legal hurdles as the Department of Justice (DOJ) is fighting its efforts to intervene in pending litigation, United States of America v. Miami-Dade County, to enforce a future draft consent decree.
