EPA Offers Utility MACT Compliance Alternative During Boiler 'Startups'

EPA is offering the utility industry an alternative option for complying with its power plant maximum achievable control technology (MACT) emissions rule during "startups" of boilers used at power plants, a concession to industry groups that successfully petitioned the agency to reconsider the rule's boiler startup compliance provisions. EPA approved the new compliance option in a rule released Nov. 7 alongside a separate rule establishing a phased approach for utilities to report air toxics data required under the utility MACT to one database, rather than the existing systems of two databases. The updates to the compliance and data requirements come as the Supreme Court is weighing whether to hear a suit challenging other aspects of the rule. The high court is scheduled to consider the appeal at its Nov. 25 conference.
