Industry Wins Preferred 4th Circuit Venue For EPA Cooling Water Rule Suit

Energy industry groups have won their preferred venue of the U.S. Court of Appeals for the 4th Circuit to hear multiple challenges to EPA's Clean Water Act (CWA) cooling water intake rule, following weeks of uncertainty of the venue after industry and environmentalists filed suits over the rule in six different circuits. The U.S. Judicial Panel on Multidistrict Litigation announced in a Sept. 22 consolidation order that the six pending challenges to EPA's cooling water rule will be heard in the 4th Circuit, which the Cooling Water Intake Structure Coalition (CWISC), an industry group, had requested in its Sept. 6 petition for review.
