Plaintiffs seeking to force EPA and other agencies to require greenhouse gas (GHG) reductions as part of their public trust duty are urging the appellate court hearing the case to squarely address the issue, referencing a recent Pennsylvania Supreme Court ruling that held judges are not precluded by the political question doctrine from considering climate and other claims in novel "public trust" doctrine cases. The youth plaintiffs in the case, Alec L., et al. v. Gina McCarthy, et al, are urging the U.S. Court of Appeals for the District of Columbia Circuit to overturn a lower court ruling that dismissed their suit, where the trial judge found there is no federal public trust duty and that even if there were, the relief sought in the suit would be displaced by EPA's GHG rules.
