A chemical producer is challenging before EPA's Environmental Appeals Board (EAB) a high-profile $2.5 million penalty that it is facing for failing to report chemical risk information in a case that could clarify what data companies must report to the agency under the Toxic Substances Control Act (TSCA) and when they must report it. Elementis Chromium, Inc., the only domestic manufacturer of hexavalent chromium (Cr6), Jan. 15 asked the EAB to overturn an administrative law judge's (ALT) November ruling that the company violated section 8(e) of TSCA by not forwarding to EPA a 2002 study showing increased risk of lung cancer to workers exposed to Cr6, which is widely used as an anti-corrosive agent in pigments, dyes, paints and plastics and in the production of stainless steel.
