Oil, construction, trucking and other industry groups are looking to an appellate court to overturn EPA's grant of a Clean Air Act waiver that allowed California to set stricter emissions standards for on-road vehicles than federal rules, aiming to end the agency's longstanding interpretation of the air law allowing stricter state limits. If successful, the suit pending in the U.S. Court of Appeals for the 9th Circuit could raise questions over whether California can win EPA approval to set rules tougher than federal standards for reducing conventional pollutants and greenhouse gases (GHGs) from a range of mobile sources. The air law allows the state to apply for a waiver to set stricter standards than EPA- and if the waivers are granted, other states can adopt those rules.
