EPA Grants Industry Request For Longer Cleanup NESHAP Comment Period

EPA has extended until the end of July the public comment period on its proposed rule to eliminate emissions control exemptions for site cleanups performed under federal waste law, responding to requests from industry, which argued for more time to evaluate the impacts of the changes and contends EPA has failed to acknowledge the proposal's negative impacts to cleanups. The agency in a notice posted on regulations.gov June 24 agreed to extend the comment period an additional 30 days until July 27 on proposed amendments to its site remediation national emissions standards for hazardous air pollutants (NESHAP) air toxics regulation. EPA is proposing to scrap emissions control exemptions for site cleanups performed under Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) authority or under a Resource Conservation and Recovery Act (RCRA) corrective action or order.
