A broad swath of current and former policymakers, state and local officials, business groups - and even a fossil-heavy utility - are backing EPA's defense of its landmark greenhouse gas rule for existing power plants, arguing in amicus briefs that the rule fits squarely within the Clean Air Act, is achievable due to existing efforts, adopts cost-effective methods and is necessary to mitigate climate risks. For example, separate briefs from current and former lawmakers, as well as the principal staff drafters of the Clean Air Act and two former Republican EPA administrators, largely serve to push back against opponents' claims that the existing source performance standards (ESPS) rule exceeds EPA's authorities under the air act.
