Industries Float Legal Defenses For CWA Rule, Urge EPA To Narrow Scope

Industry groups are offering legal defenses for EPA's proposal to narrow its Clean Water Act (CWA) jurisdiction standard compared to an Obama-era rule on the law's reach, but they are also urging the agency to restrict jurisdiction even further than planned by placing new limits on regulating "traditional navigable waters" (TNWs). "We believe the proposed rule accomplishes the agencies' intent to establish categorical discrete lines that provide clarity and predictability for regulators and the regulated community. The final rule, however, could benefit from some additional clarification and minor revisions," electric utility Duke Energy says in its comment letter.
