Judge Questions EPA's NPL Listing, Raising Prospects Of Rare Loss

A federal court judge on an appellate panel is strongly questioning EPA's technical findings used to justify its listing a contaminated drinking water site in Indiana on the Superfund National Priorities List (NPL), raising the prospect of a rare loss for the agency on such a listing.But in a second round of arguments on a separate NPL listing suit, heard earlier this week, the same judge, along with a second judge, on the appellate panel doubted a mining company's attempt to exclude it from a separate NPL listing of a multi-mine site in Colorado.
