The cost of discovery in litigation and arbitration has risen in parallel with the increased number of electronic files on a given project.rnIn past decades, the "project record" in litigation was generally limited to issues that had risen to a level of importance that required the penning of a letter. That's not the case today. Electronic transmissions, such as e-mail, now dominate the day-today project record. In fact, the record at trial often is created by the thumbs of nearlyrnevery project participant hourly, if not more often. Conversations are no longer spoken-they are recorded electronically; every statement (whether relevant, truthful, untruthful, self-serving or posturing) is stored forever on hard drives.
