Research on China rural land circulation legal system based on land and energy

摘要

Within the current frameworks of collective-owned land ownership and Household-responsibility system, it is not possible for China to form a long time stable agricultural scale management since the imperfection of rural land circulation system, inefficiency of both land circulation and farming. The forming of effective land circulation mechanism relies on land banks playing a role of intermediary and service, which promotes the establishment of land contractual rights circulation market. Using the foreign advanced operation experience of land bank for reference, it explores the operation system of rural land bank. It handles the rural land mortgage in a flexible way, perfects the land property right and registration system, builds up the agricultural insurance system and etc to promote the rural land circulation.
