摘要

The article analyses the strategic actions used for the institutionalization and legitimation of the Conselho Nacional de Justi?a. The hypothesis of this paper is that the actions taken by the first councils had as consequence the formation of a technical agenda of the CNJ, focused primarily on questions of administrative and judicial management, to the detriment of punitive actions. The work was based on documentary analysis of the conflict around the idea of the control of the Judiciary since the Assembleia Nacional Constituinte and semi-structured interviews with relevant actors who participated in the decision-making process that institutionalized the CNJ. Finally, based on a theoretical reference of historical institutionalism, we evaluate how much the CNJ is an institutional innovation in the structure of the Brazilian Judiciary
